TERMS OF SERVICE

These Terms of Service govern your use of the Nose & Frame online store and your purchase of products and services from us.
By accessing our store or placing an order, you agree to these Terms of Service. Nothing in these Terms affects consumer rights that cannot legally be excluded or restricted.
ABOUT NOSE & FRAME
Nose & Frame provides personalised pet portrait artwork printed on canvas.
Our online store is powered by Shopify. We may use third-party providers to assist with payments, artwork processing, printing, fulfilment and delivery.
ORDERS
When you place an order, you agree that the information you provide is accurate and complete.
Submitting an order does not prevent us from contacting you if additional information is required to create or fulfil your personalised product.
We reserve the right to refuse or cancel an order where reasonably necessary, including where:
• Payment has not been successfully authorised.
• Required personalisation information has not been supplied.
• The supplied material cannot reasonably be used to create the product.
• We reasonably believe an order is fraudulent or unlawful.
• A product or service has been listed with an obvious pricing or technical error.
• We cannot fulfil the order for reasons outside our reasonable control.
Where we cancel an order after payment and no amount is lawfully due for work already undertaken, an appropriate refund will be provided.
PERSONALISED PRODUCTS
Nose & Frame products are created using photographs and information supplied by customers.
You are responsible for providing clear and accurate photographs, names, instructions and other personalisation information.
You confirm that you own, or otherwise have the necessary permission or rights to provide, any photograph or other material you submit to us for the purpose of creating your order.
You must not knowingly submit material that infringes another person's intellectual-property, privacy or other legal rights.
ARTWORK CREATION
We use the photograph and information you provide to create a personalised artistic interpretation of your pet.
Because the product is an artistic interpretation, the finished artwork may not reproduce every detail of the original photograph exactly.
ARTWORK PREVIEW AND REVISIONS
We provide an artwork preview before your canvas enters production.
Your order includes up to two reasonable revision requests.
Revision requests should relate to the personalised artwork originally ordered. A request that substantially changes the original order or requires an entirely different photograph or concept may be treated as a new request and may require additional agreement or payment.
Nothing is sent for printing until you approve the artwork.
ARTWORK APPROVAL
You are responsible for reviewing the artwork preview carefully before approval.
This includes checking:
• Your pet's appearance.
• Pet name and spelling.
• Layout and positioning.
• Any other personalised information displayed in the artwork.
When you approve the artwork, you authorise us to proceed with production using that approved design.
Approval does not affect your statutory rights if the physical product subsequently supplied is faulty, damaged, not as described or otherwise does not conform to the contract.
PRICES AND PAYMENT
Prices are displayed in the currency shown on our store.
The total price, including applicable delivery charges and any taxes collected at checkout, will be displayed before you complete your purchase.
Payment must be made using one of the payment methods available at checkout.
We may change product prices from time to time. Any price change will not alter the agreed price of an order that has already been accepted, except where permitted by applicable law.
DELIVERY
Production begins after artwork approval.
Delivery charges and available delivery options are displayed at checkout.
Delivery dates and timeframes are estimates unless a specific delivery date has expressly been agreed.

CANCELLATIONS, RETURNS AND REFUNDS
Because our pet portraits are personalised and made to a customer's specifications, the standard change-of-mind cancellation or withdrawal right applicable to many online purchases may not apply where the legal exemption for personalised or made-to-order goods applies.
This does not affect your statutory rights where goods are faulty, damaged, not as described or otherwise do not conform to the contract.

INTELLECTUAL PROPERTY
The Nose & Frame website, branding, store design and other original business content may be protected by intellectual-property law.
You may not reproduce, distribute or commercially exploit our protected website or business content without permission except where permitted by law.
CUSTOMER PHOTOGRAPHS
You retain any rights you hold in photographs you provide to us.
By providing a photograph or other material, you give us permission to use and process that material to the extent reasonably necessary to create your artwork, provide previews and revisions, produce and fulfil your order, provide customer support and meet applicable legal obligations.
We do not obtain ownership of your original photograph merely because you upload it when ordering.
USE OF CUSTOMER ARTWORK FOR MARKETING
We will not rely on these Terms alone as permission to publicly use an identifiable customer's photograph or personalised portrait for advertising, social media or promotional purposes.
Where we wish to use customer material publicly for those purposes, we may request separate permission where appropriate.
ACCEPTABLE USE
You must not use our website or Services:
• For unlawful or fraudulent purposes.
• To violate another person's rights.
• To submit malicious software or harmful code.
• To interfere with the security or operation of the website.
• To provide material that you do not have the right to provide.
THIRD-PARTY SERVICES
Our store may rely on third parties, including Shopify and providers involved in payment processing, technology, printing, fulfilment and delivery.
Where you use an independent third-party service or website, additional terms or privacy policies may apply.
WEBSITE AVAILABILITY
We aim to keep our website and Services available and accurate, but we cannot guarantee uninterrupted or error-free operation.
We may update, modify or temporarily suspend parts of the website where reasonably necessary for maintenance, security, technical or business reasons.
PRODUCT INFORMATION
We take reasonable care to present product information and images accurately.
Colours and appearance can vary depending on screens, devices and printing processes.
Any such variation does not limit your statutory rights where the product does not conform to the contract.
LIABILITY
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
Nothing in these Terms excludes or restricts your statutory consumer rights.
To the extent permitted by applicable law, we are not responsible for losses resulting solely from circumstances that were not reasonably foreseeable or were outside our reasonable control.
We do not exclude liability that cannot legally be excluded.
PRIVACY
Our collection and processing of personal information is described in our Privacy Policy.
Please review that policy for information about customer photographs, personalised artwork, service providers, cookies, data retention and your data-protection rights.
CHANGES TO THESE TERMS
We may update these Terms of Service from time to time to reflect changes to our business, Services or applicable legal requirements.
The version that applies to an order will be determined in accordance with applicable law and the terms made available to you when the relevant contract was formed.
SEVERABILITY
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
GOVERNING LAW
These Terms are governed by applicable Irish law.
If you are a consumer, nothing in these Terms deprives you of mandatory consumer protections or rights that apply to you under applicable Irish or European Union law.
